As further described in the section below, our websites and online services store and retrieve cookie identifiers, mobile IDs, and other data. We and our service providers may use other technologies to collect page interaction information and other electronic communications and content from your use of the services (such as content entry, mouse movements, screen captures, the date, time, and location of your visit, what areas of the services you visit and for how long, what search terms or other data you enter, and what content you view and click on), and methods used to browse away from the services. • Publicly available sources. Public sources of information such as open government databases.

When you are asked to provide personal data, you may decline. And you may use web browser or operating system controls to prevent certain types of automatic data collection. But if you choose not to provide or allow information that is necessary for certain services or features, those services or features may not be available or fully functional. We and our service providers may combine and or append the types of information described above to our existing information to better understand your interests and to provide more relevant content and services.

We, our service providers, and third parties, use cookies, web beacons, and other tracking technologies (collectively, “Technologies”) to collect personal and other data, including Internet and network activity, geolocation data, and device information.

What are cookies, web beacons, and other tracking technologies?

Cookies are small text files placed by a website and stored by your browser on your device. A cookie can later be read when your browser connects to a web server in the same domain that placed the cookie. The text in a cookie contains a string of numbers and letters that may uniquely identify your device and can contain other information as well. This allows the web server to recognize your browser over time, each time it connects to that web server.

Web beacons are electronic images (also called single-pixel or clear GIFs) that are contained within a website, application or email. When your browser opens a webpage or email that contains a web beacon, it automatically connects to the web server that hosts the image (typically operated by a third party). This allows that web server to log information about your device and to set and read its own cookies. In the same way, third-party content on our websites (such as embedded videos, plug-ins, or ads) results in your browser connecting to the third-party web server that hosts that content. Web beacons can placed be in our email messages or newsletters to tell us if you open and act on them.

An embedded script is programming code that is designed to collect information about your interactions with the services. It is temporarily downloaded onto your computer from our web server or a third party with whom we work, is designed to be active only while you are connected to the service, and is deleted or deactivated thereafter.

Other technologies that may operate similarly to cookies or web beacons may be used to collect information about you or your device when using our services.

How do we, our service providers, and third parties use Technologies?

We, our service providers, and third parties use Technologies on our website and services to collect personal data. Personal data about your online activities may also be collected over time and across different websites or online services.

We and our service providers use personal data collected from Technologies for a variety of purposes, such as to store your preferences and settings, enable you to sign-in, analyze how our websites and applications perform, track your interaction with the site or app, develop inferences, deliver and tailor interest-based advertising and recruiting, combat fraud, and fulfill other legitimate purposes. We and our service providers may also disclose the personal data we collect or infer with others to assist with these purposes.

Companies acting as third parties (“Third-Party Partners”) use personal data collected from Technologies for our purposes and other purposes. We work with these Third-Party Partners for a variety of purposes, including analytics, personalization, fraud, security, and interest-based recruiting and advertising. These   Third-Party Partners may use and combine this data across multiple sites for their own and third-party purposes. This privacy notice does not cover any use of information that such third parties themselves may have collected from you (e.g., type of browser, operating system, domain name, day and time of visit, page(s) visited) or the methods used by the third-parties to collect that information (e.g., cookies, web beacons and clear gifs). For example, we use Google Analytics on our website to help us understand how users interact with our website; you can learn how Google collects and uses information at www.google.com/policies/privacy/partners. Some of the data disclosures to these Third-Party Partners may be considered a “sale” or “sharing” of personal data as defined under certain U.S. state laws. Please see Choice and Control of Personal Data and its subsection Do Not Sell or Share My Personal Data below for more details.

What Technology controls are available?

There are a range of cookie and Technology related controls available through browsers, mobile operating systems, and elsewhere. See the section covering Choice and Control of Personal Data below for details.

You may use web browser or operating system controls to prevent certain types of automatic data collection. But if you choose not to provide or allow information that is necessary for certain services or features, those services or features may not be available or fully functional.

This section describes the purposes for which we use personal data and the legal basis under applicable law pursuant to which we process it.

Privacy Rights – access, portability, correction, and deletion.

If you wish to access, correct, or delete personal data about you that we hold, please see the Privacy Rights section below or you may also CONTACT US for more information.

Communications preferences.

You can choose whether to receive marketing communications from us by email, SMS, physical mail, and telephone. If you receive promotional email or SMS messages from us you can opt-out of receiving such communications from us at any time by following the instructions provided in that message, replying “STOP”, or by contacting us as described in the Contact Us section below. Please note that even if you opt out of receiving promotional emails, text messages or other communications, we and our agents, vendors, and service providers may continue to send you non-promotional e-mails and text messages and other types of communications, such as surveys or those mandatory to provide our services, as permitted by law.

Targeted advertising.

To opt-out from having personal data we collect from you in connection with our services used for targeted advertising, you can use the “Cookie Preferences” banner controls available through our website at the bottom of every page to decline advertising-related Technologies; or other options may also be available to help reduce targeted advertising, but may not prevent having personal data we, and the Third-Party Partners we work with, collect from you being used for targeted advertising. These options include:

  • Industry opt-out tools. These include the NAI (http://optout.networkadvertising.org), DAA (http://optout.aboutads.info/), and European DAA (http://www.youronlinechoices.com/)
  • Cookie controls. Most web browsers are set to accept cookies by default. If you prefer, you can go to your browser settings to learn how to delete or reject cookies. If you choose to delete or reject cookies, this could affect certain features or services of our website. If you choose to delete cookies, settings and preferences controlled by those cookies, including advertising preferences, may be deleted and may need to be recreated.
  • Do Not Track. Some browsers include a “Do Not Track” (DNT) setting that can send a signal to the websites you visit indicating you do not wish to be tracked. Because there is not a common understanding of how to interpret the DNT signal, our website and services do not respond to browser DNT signals.
  • Mobile advertising ID controls. iOS and Android operating systems may provide options to limit tracking and/or reset advertising IDs commonly used to help targeted advertising.

All of the options in this section are specific to the device or browser you are using. If you access our services from other devices or browsers, take these actions on those devices and browsers as well.

Do Not Sell or Share My Personal Data.

Some laws define “sell” and “share” very broadly, and some of our data sharing described in this privacy notice may be considered a “sale” or “sharing” under those definitions. In particular, Third-Party Partners may collect identifiers, device information, and usage data through our website and services, including as further described in the Cookies, Web Beacons, and Other Technologies section above.

If you do not wish for us to “sell” personal information, or “share” personal information for targeted advertising purposes, please utilize the Cookie banner controls. If you opt-out using these choices, we will take steps to stop disclosing personal data in ways that are considered a “sale” or “sharing” (for targeted advertising) for which opt-out rights are required under applicable law. However, we will continue to disclose personal data to service providers and others as allowed by applicable law.

Email web beacons.

Most email clients have settings that allow you to prevent the automatic downloading of images, including web beacons, and the automatic connection to the web servers that host those images.

Touch ID.

If you use our services through an Apple, Inc. (“Apple”) Device or an Android/Google Device, we may offer Face ID/Touch ID or Face Unlock/Fingerprint Unlock for such devices as an alternative log-in method to password. We are only notified as to whether the authentication was successful and cannot access the Face ID or Touch ID nor the Face Unlock or Fingerprint Unlock or the data associated with the use of such capabilities. For more details, see Apple’s iOS Security Guide at:  https://www.apple.com/business/docs/iOS_Security_Guide.pdf; see Google/Android’s Security Guide at https://source.android.com/security.

This section VI applies only to individuals in the countries or jurisdiction which grant the rights described within this section and will apply only in certain circumstances. When requests are received, we intend to take reasonable steps to verify the identity of the requestor prior to fulfilling a request. The verification steps may vary depending on the sensitivity of the personal data related to the request.

Where we receive a request to exercise one of these rights, we will provide information on the action we take on the request without undue delay but this time may be extended in certain circumstances, for example, where requests are complex or numerous. We generally do not charge a fee for a request; however, we may charge a small administration fee to respond to a request as allowed by applicable law and in certain exceptional circumstances.

Except for the automated controls described in this privacy notice, if you send us a request to exercise your rights or these choices, to the extent permitted by applicable law, we may decline requests in certain cases. For example, we may decline requests where granting the request would be prohibited by law, could adversely affect the privacy or other rights of another person, would reveal a trade secret or other confidential information, or would interfere with a legal or business obligation that requires retention or use of the data. Further, we may decline a request where we are unable to authenticate you as the person to whom the data relates, the request is unreasonable or excessive, or where otherwise permitted by applicable law. If you receive a response from us informing you that we have declined your request, in whole or in part, you may appeal that decision by submitting your appeal using the CONTACT US information at the bottom of this notice.

If the processing of personal data about you is subject to the laws of the European Economic Area, Switzerland, or the United Kingdom, you have certain rights with respect to that data:

  • You can request access to, and rectification or erasure of, personal data;
  • If any automated processing of personal data is based on your consent or a contract with you, you have a right to transfer or receive a copy of the personal data in a usable and portable format;
  • If the processing of personal data is based on your consent, you can withdraw consent for future processing at any time;
  • You can object to, or obtain a restriction of, the processing of personal data under certain circumstances; and
  • For residents of France, you can send us specific instructions regarding the use of your data after your death.

To make such requests, please use our data request form or the CONTACT US information at the bottom of this notice. You also have the right to lodge a complaint with a supervisory authority, but we encourage you to first contact us with any questions or concerns.

We rely on different lawful bases for collecting and processing personal data about you, for example, with your consent and/or as necessary to provide the services you use, operate our business, meet our contractual and legal obligations, protect the security of our systems and our customers, or fulfil other legitimate interests.

If you are a California resident and the processing of personal information (hereinafter referred to as “personal data”) about you is subject to the California Consumer Privacy Act (CCPA), you have certain rights with respect to that information.

Notice at Collection.

At or before the time of collection, you may have a right to receive notice of our practices, including the categories of personal information and sensitive personal information to be collected, the purposes for which such information is collected or used, whether such information is sold or shared, and how long such information is retained. You can find those details in this notice by clicking on the above links.

Subject to verification of your request, you may exercise your privacy rights listed below in relation to the personal data we have collected about you.

  • The right to know what personal data we have collected about you;
  • The right to delete your personal data;
  • The right to correct your personal data;
  • The right to limit the use and disclosure of sensitive personal data (Note that we do not use sensitive personal information for any such additional purposes but are required to provide this notice.);
  • The right to opt-out of the “sale” or “sharing” of your personal data; and
  • The right to non-discrimination for exercising your privacy rights.

You may make such requests by submitting our data request form, mail or email found in the CONTACT US section of this privacy notice or calling 866-727-4714 to submit a deletion or correction request.  Further, to provide, correct, or delete specific pieces of personal data we will need to verify your identity. The verification process and requirements may vary based on the type of request and the sensitivity of the personal data.

You may designate, in writing or through a power of attorney, an authorized agent to make requests on your behalf to exercise your rights under the CCPA. Before accepting such a request from an agent, we will require the agent to provide proof you have authorized it to act on your behalf, and we may need you to verify your identity directly with us. Even with a designated agent or representative, we will only provide your personal data related to an access request directly to you unless you contact us and direct us in writing to provide the data to another individual or business.

Right to Opt-Out / “Do Not Sell or Share My Personal Data”.

Some California laws define “sell” and “share” very broadly, and some of our data sharing described in this privacy notice may be considered a “sale” or “sharing” under those definitions. In particular, Third-Party Partners may collect identifiers and device information and usage data through our website and services, including as further described in the Cookies, Web Beacons, and Other Technologies section above and should be used to manage such “sales” or “sharing”. We do not knowingly sell or share the personal data of minors under 16 years of age.submittin

The personal data we collect may be stored and processed in your country or region, or in any other country where we or our affiliates, subsidiaries, or service providers process data, some of which may have laws that offer different levels of data protection than the country in which you reside. Currently, we primarily use data centers in Canada, the United States and the United Kingdom.  We take steps to process and protect personal data as described in this notice wherever the data is located.

Location of Processing European Personal Data.

We transfer personal data from the European Economic Area (EEA), United Kingdom (UK), and Switzerland to other countries, some of which have not been determined by the European Commission to have an adequate level of data protection. When we do so, we use legal mechanisms, including contracts and adequacy decisions, to help ensure your rights and protections. To learn more about the European Commission’s decisions on the adequacy of personal data protections, please visit: https://commission.europa.eu/law/law-topic/data-protection/international-dimension-data-protection/adequacy-decisions_en.

We retain personal data for as long as necessary to provide the services and fulfill the transactions you have requested, comply with our legal obligations, resolve disputes, enforce our agreements, and for other legitimate and lawful business purposes. Because these needs can vary for different data types in the context of different services, actual retention periods can vary significantly based on criteria such as user expectations or consent, the sensitivity of the data, the availability of automated controls that enable users to delete data, and our legal or contractual obligations.

We take reasonable and appropriate measures, including the use of a variety of security technologies, to help protect personal data from unauthorized access, use, disclosure, alteration, and destruction.

To help us protect personal data, we request that you use a strong password, never share your password with anyone, and never use the same password with other services or accounts.

We will update this privacy notice when necessary to reflect changes in our services, how we use personal data, or the applicable law. When we make changes to the notice, we will revise the “Last Updated” date at the top of the privacy notice.
